Should I hire an attorney for a car accident

How to Secure Compensation After a Car Accident When the At-Fault Driver Is Uninsured or Underinsured

If you’ve been injured in a car accident caused by another driver, you may be seeking compensation for your accident-related expenses through the at-fault driver’s insurance provider. Depending on the severity of your injuries and the cost of damages, these expenses can add up quickly. In most cases, the responsible driver’s insurance should cover a substantial portion of these costs. However, complications can arise if the other driver lacks insurance or has insufficient coverage.

Hiring an experienced personal injury attorney after an accident can help ensure you avoid common pitfalls and receive the full compensation you’re entitled to for your injuries and related damages. A skilled attorney will help ensure that you file all necessary paperwork on time, meet all legal deadlines, and accurately value your case. They can also provide vital guidance if the responsible driver has little or no insurance.

What Can a Personal Injury Lawyer Do if the Other Driver Lacks Adequate Insurance?

In cases where the at-fault driver lacks sufficient insurance, or none at all, an attorney can help you explore alternative avenues for compensation. Most claims are initially filed against the responsible driver’s insurance provider. This process means you typically don’t need to sue the driver directly unless their coverage is too low to cover your damages.

While you might expect the insurance company to offer a fair settlement, this is often not the case. Initial settlement offers are frequently too low to adequately cover both economic and non-economic damages. After a serious accident, you shouldn’t be left with out-of-pocket expenses for losses caused by another’s negligence. With experienced legal representation, you stand a much better chance of obtaining a fair settlement or exploring other avenues if necessary.

Damages You May Be Entitled To

Depending on your specific case, you may be eligible for compensation for:

  • Pain and suffering
  • Current and future medical expenses
  • Lost wages
  • Property damage
  • Loss of consortium
  • Loss of enjoyment of life
  • Emotional distress

A personal injury attorney can help you identify the full range of damages you’re eligible to recover, ensuring you are compensated fairly.

Filing a Personal Injury Lawsuit Against an Uninsured Driver

If the driver responsible for your accident is uninsured and you lack uninsured or underinsured motorist coverage, a lawsuit may be the only way to seek compensation. Filing a personal injury lawsuit requires demonstrating that the other driver’s actions directly caused the accident and your injuries. If the at-fault driver was cited at the scene or charged with reckless driving, proving fault may be relatively straightforward. However, when liability is disputed, a more detailed investigation may be necessary.

It’s important to note that if the uninsured driver has no valuable assets, even a successful lawsuit may yield an unenforceable judgment, leaving you without a practical means of recovering damages. An attorney can help you evaluate whether pursuing a lawsuit is worthwhile.

Filing a Claim Against Your Own Insurance Company

If you sustained serious injuries or property damage and the other driver’s insurance is insufficient, you may need to turn to your own insurance provider. California law does not require drivers to carry uninsured or underinsured motorist coverage, but if you have this type of policy, it could cover the gap left by the at-fault driver’s insufficient insurance.

With uninsured or underinsured motorist coverage, you can file a claim with your own insurance provider. An attorney can assist with filing this type of claim, which requires proving that the at-fault driver was uninsured or inadequately insured at the time of the accident.

How Uninsured Motorist Coverage Works

Uninsured motorist insurance provides coverage for injuries caused by a driver without insurance, and often includes underinsured motorist coverage. It generally covers you and any passengers in your vehicle, regardless of whether you’re the driver, a pedestrian, or a bicyclist involved in a collision with an uninsured motorist. Uninsured motorist coverage can compensate you for:

  • Pain and suffering
  • Medical expenses (current and future)
  • Lost wages
  • Permanent disability or disfigurement
  • Loss of quality of life

This coverage may extend to family members living in your household and may even apply to accidents involving hit-and-run drivers. However, it typically does not cover property damage, so if your vehicle is damaged, you may need separate collision coverage to cover repairs.

Challenges in Uninsured Motorist Claims

Claims involving uninsured or underinsured motorist coverage can be complicated due to specific policy language and exclusions. When filing such a claim, you are essentially making a claim against your own insurance provider, which may prioritize minimizing payouts. This is why legal representation can be crucial—an attorney will ensure your claim is valued accurately and that your rights are protected. In some cases, more than one party may share liability, adding complexity to your claim.

Filing a Lawsuit Against Your Insurance Company

If your insurance company refuses to offer fair compensation for your uninsured motorist claim, you have the option to file a lawsuit. Although most cases settle before reaching court, the possibility of a lawsuit can sometimes prompt an insurance company to offer a fair settlement. Should your case proceed to trial, your attorney can present your case before a judge or jury, ensuring your rights to compensation are protected.

Thorough Accident Investigation

Whether you’re filing an insurance claim or pursuing a personal injury lawsuit, an experienced attorney will start by thoroughly investigating your accident. They’ll gather key evidence to establish liability and accurately value your damages. An attorney may:

  • Visit the accident scene
  • Collect photographic evidence
  • Obtain copies of the police report
  • Review medical records and bills
  • Consult accident reconstruction experts, medical professionals, and other relevant experts
  • Collect witness statements

A detailed investigation helps ensure you receive full compensation for both economic and non-economic damages.

Valuing Your Accident Claim

Your attorney will work with medical experts and other specialists to determine the full extent of your losses, including past and future medical treatment costs, lost income, and pain and suffering. Severe injuries typically warrant higher claim values, especially when they require ongoing medical treatment or result in long-term disability.

Negotiating with Insurance Companies

Negotiating with an insurance company after an accident can be challenging, especially when dealing with your own insurance provider. Insurers often make low initial offers, hoping that accident victims will accept quick settlements out of necessity. An experienced attorney will negotiate on your behalf, often leading to significantly better compensation. This process can take time, but the outcome is usually worth it.

Additional Resources for Recovering Costs After an Accident with an Uninsured Driver

If the other driver lacks insurance, there may be other options for covering medical and repair costs:

  • Health Insurance: Your health insurance may cover your medical expenses, but the insurance provider may seek reimbursement if you later receive uninsured motorist proceeds.
  • Medical Payments Coverage (Med Pay): Optional coverage in California, Med Pay can cover medical expenses and funeral costs for policyholders and passengers after an accident, regardless of who is at fault.

How Your Car Accident Lawyer Will Handle Insurance Companies

Why You Need a Car Accident Lawyer to Handle Insurance Companies After an Accident

When you’re injured in an auto accident caused by a negligent driver, it’s common for the at-fault driver’s insurance company to contact you soon afterward. While the claims adjuster may appear friendly and sympathetic, their primary goal is to minimize the amount they pay out—if they pay anything at all. If you’re facing mounting medical bills and other financial pressures, you may feel tempted to accept a low settlement offer. However, these early offers rarely cover the full extent of your damages.

At LA Law Group, our experienced car accident attorneys will handle all interactions with the insurance company on your behalf. When you hire us, you’ll no longer need to worry about phone calls or communication with the insurance adjuster. We take on the insurance companies, protecting your rights and working to secure the fair compensation you deserve.

How a Car Accident Lawyer Manages Insurance Company Interactions

A car accident lawyer’s role in dealing with insurance companies is to protect your claim and ensure you don’t accidentally say anything that might jeopardize your case. Insurance adjusters may ask confusing or misleading questions, hoping to elicit statements they can use to weaken your claim.

With an attorney representing you, all communication from the insurance company will go through your lawyer. Adjusters will not be able to contact you directly. This arrangement not only preserves your peace of mind but also strengthens your case by ensuring that all statements and evidence are managed carefully and professionally.

How a Car Accident Lawyer Negotiates with Insurance Companies on Your Behalf

Once you hire a car accident lawyer, they’ll begin by reviewing your case, investigating the accident, and gathering evidence to establish fault and demonstrate the extent of your injuries. They may also consult with experts to accurately value your claim. With all of this information, your lawyer will prepare and send a demand letter to the insurance company. This letter outlines:

  • The details of the accident
  • The responsible party
  • Evidence of the other driver’s negligence
  • A clear demand for compensation, supported by documentation such as medical records, repair estimates, witness statements, and photos of your injuries and property damage

The insurance company will either accept this demand or make a counteroffer. Your attorney will review each offer with you, advising on whether to accept it or to continue negotiating for a fair settlement.

A skilled attorney will keep the pressure on the insurance company, ensuring they don’t delay or undercut your claim. Once a settlement has been reached, you’ll sign a release form acknowledging that you accept the settlement and will take no further legal action regarding the accident.

How Do I Increase My Personal Injury Settlement

Maximizing Compensation After an Accident Caused by Negligence

If you’ve been injured in an accident caused by someone else’s negligence, pursuing legal action to seek compensation for your damages is essential. Severe injuries, property damage, and other losses can take a heavy toll, and it’s critical to demonstrate the full impact of these damages to maximize the compensation you can recover.

At LA Law Group, our personal injury attorneys have put together this guide to help you understand the steps you can take to strengthen your case and recover the compensation you deserve.

How to Prove Damages After an Accident

To increase your compensation, you need to clearly show how the accident has impacted your life—whether it has limited your ability to work, diminished your quality of life, or created lasting pain. Here are strategies to support your claim for damages:

1. Hire a Personal Injury Attorney

Working with an experienced personal injury attorney is one of the best ways to maximize your potential settlement. At LA Law Group, our attorneys understand the tactics insurance companies use to reduce or deny claims. We know how to gather the right evidence to back up your case and push for the compensation you’re owed. With professional legal support, you’re much more likely to secure a fair settlement than if you navigate the process alone.

2. Gather and Document Evidence

Documentation is key to building a strong case. Collect and maintain the following evidence to support your claim:

  • Photographs: Take pictures of your injuries immediately after the accident and throughout your recovery, as well as photos of any property damage.
  • Property Damage Estimates: Secure repair estimates for any damaged property.
  • Medical Records: Retain all records related to treatments, diagnoses, and doctor’s notes.
  • Expert Testimony: Use statements from medical and other relevant experts to back your claims.
  • Personal Statements: Gather statements from family, friends, and coworkers describing how your injuries have impacted your daily life.
  • Pain Journal: Keep a daily record of your pain levels, activities you can no longer perform, and how your injuries affect you.

3. Demonstrate the Extent of Your Injuries

Attending all doctor’s appointments and strictly following treatment recommendations are essential. Your medical records and your doctor’s insights on your recovery can play a significant role in supporting your claim. A physician’s statement detailing the limitations imposed by your injuries—such as restrictions on movement, lifting, standing, or working—can make a substantial difference in the outcome of your case.

4. Calculate Medical Expenses and Lost Income

If your injuries have prevented you from returning to work, a personal injury attorney will work with experts to estimate both your current and future losses. This assessment may involve consultations with medical professionals, economists, and vocational experts who can evaluate the impact of your injuries over the long term. These experts can provide insights into potential medical expenses, future income loss, and the overall economic burden of your injury.

PTSD Risks Following Car Accidents

Understanding PTSD After a Car Accident: Legal Options and Treatment

Post-traumatic stress disorder (PTSD) is a serious anxiety disorder that can develop after a traumatic event like a motor vehicle accident. PTSD symptoms can be severe and life-altering, impacting daily life, work, and relationships. If you’ve been diagnosed with PTSD following a car accident, you may be eligible for compensation to cover therapy and other treatments that aid recovery.

How Common is PTSD After Car Accidents?

While physical injuries are often the initial focus after an accident, the emotional and psychological effects, like PTSD, are frequently overlooked. Car accidents are one of the most common causes of PTSD in the general population, yet many victims remain unaware of its symptoms or may not seek treatment.

What Increases the Risk of Developing PTSD After a Car Accident?

Approximately 6% of people experience PTSD at some point, and women and military members are statistically more vulnerable. Several factors can increase the likelihood of PTSD after a car accident, including:

  • A history of substance abuse
  • A family history of mental health disorders
  • Past trauma or abuse
  • Lack of a support network
  • A prior diagnosis of depression or other mental health issues

How is PTSD Treated?

For those diagnosed with PTSD after a car accident, mental health professionals can provide crucial support. Treatment plans are tailored to the individual and may involve a combination of therapies and medications. Common treatments for PTSD include:

  • Mindfulness practices to manage stress and anxiety
  • Lifestyle adjustments that promote mental well-being
  • Support groups to connect with others who understand the challenges
  • Medication, such as antidepressants and anti-anxiety drugs
  • Talk therapy and Cognitive Behavioral Therapy (CBT) to process trauma and develop coping strategies

Recognizing PTSD Symptoms After an Accident

Symptoms of PTSD following a car accident can vary but often include:

  • Intrusive thoughts about the accident
  • Involuntary memories or flashbacks
  • Nightmares related to the incident
  • Avoidance of reminders of the crash

PTSD symptoms may last for days, months, or even years. With treatment, many people experience significant improvement within several months to a year. However, untreated PTSD symptoms can worsen over time, so early intervention is encouraged.

A List of Common Injuries From Car Accidents.

Auto accidents can leave victims with life-altering injuries, from which recovery may take years—or, in severe cases, may never fully happen. After an injury, seeking immediate medical care is essential to prevent further health complications and lay the groundwork for recovery.

At LA Law Group, our dedicated car accident attorneys recognize the profound impact serious injuries can have, both physically and emotionally. Common Injuries Sustained in Auto Accidents

Car accidents can result in a wide range of injuries, from minor sprains to catastrophic, life-changing trauma. Here are some of the most common injuries we encounter:

  • Traumatic Brain Injuries (TBIs): Car crashes are a leading cause of TBIs, resulting from blunt force trauma or piercing injuries to the head. Such injuries can have lasting cognitive, emotional, and physical effects.
  • Spinal Cord Injuries: The intense force of a collision can severely damage the spinal cord, sometimes resulting in partial or complete paralysis below the injury site.
  • Back Injuries: The spine is particularly vulnerable in high-impact crashes. Even if back pain is not immediately apparent, injuries can surface days later and often require extensive treatment over time.
  • Burns: In accidents where fires, hot surfaces, chemicals, or steam are involved, burn injuries can occur, sometimes requiring multiple surgeries or skin grafts to treat.
  • Internal Injuries: When the body sustains blunt force trauma or is struck by debris, damage to organs can occur, often necessitating emergency intervention for internal bleeding or organ repair.
  • Fractures and Broken Bones: Broken bones are frequent in auto accidents, especially in the wrists, ankles, arms, ribs, and legs, with some cases requiring surgical intervention.
  • Facial Injuries: Impact with airbags, windows, dashboards, or flying glass can cause facial injuries, some of which may lead to permanent scarring and require reconstructive surgeries.
  • Amputations: In severe cases, limbs or appendages may be crushed or injured to the extent that surgical amputation is necessary, leading to lifelong adjustments and medical care needs.
  • Whiplash and Neck Injuries: Whiplash and other neck injuries are common even in low-speed collisions and can cause lasting pain and mobility issues.
  • Shoulder Injuries: Force absorbed by bracing hands against the dashboard or steering wheel can result in shoulder injuries, which often require rehabilitation.
  • Knee Injuries: Impact with vehicle interiors during a crash can cause significant knee damage, from torn ligaments to fractures, which may necessitate surgery.
  • Hand and Wrist Injuries: Fractures and other injuries to the hand or wrist frequently occur, often requiring surgical repair depending on severity.
  • Soft Tissue Damage: Cuts, bruises, and other soft tissue injuries are common and may occur from impact with sharp objects or debris.
  • Crush Injuries: Any part of the body caught between heavy objects under pressure can suffer a crush injury, requiring specialized treatment and rehabilitation.
  • Post-Traumatic Stress Disorder (PTSD): Emotional trauma can be just as impactful as physical injuries. Many accident victims suffer from PTSD, which may require ongoing therapy and medication.

Velocity Limits for Amazon Sellers

Velocity Limits for Amazon Sellers

Alert: Amazon Sellers:

Seller Suspensions on the rise.

Amazon has a number of reasons why they suspend sellers. One new issue we saw trending are “Velocity Limits”. This is generally triggered due to Amazon’s “bots” who detect disproportional sales at an item or account level and flag the account for “Velocity Limits”. In such circumstances Amazon either withholds your disbursements, suspends the ASIN, or suspends the account.

In Q4, most of our Amazon Seller clients experience growth in sales and some are affected by the “Velocity Limits” issue.

We are familiar with how to handle velocity limits and have helped many sellers navigate through this. Initially, you as the seller will need to demonstrate to Amazon why the product(s) had an increase in sales, whether it be due to the holiday or seasonal demand for the products, advertising, or other efforts that you have taken to drive traffic and sales to the item.

Amazon will often as well want to review your purchase receipts to ensure you have purchased adequate inventory to supply the increased demand. Lastly, Amazon will monitor the performance to make sure the item(s) are timely shipped and delivered to buyers without buyer complaints.

Velocity Limits are one of the many issues we face daily at LA Law Group. We continue to fight for our clients and for Amazon sellers to ensure that they continue their success in selling on Amazon.

If you have any specific questions which you’d like us to write about, or need a free consultation regarding an issue you are having with Amazon, please feel free to contact us.
